These Terms & Conditions apply to purchases made via www.bodykaars.nl.

In these Terms & Conditions, “BODYKAARS”, “we”, “us” and “our” refer to the business identified above.

2. Applicability

These Terms & Conditions apply to every offer made by BODYKAARS and every agreement concluded between BODYKAARS and a consumer through our webshop.

Mandatory consumer protection law always takes precedence over any provision in these Terms & Conditions.

Separate terms may apply to individually agreed business or wholesale orders.

3. Products

BODYKAARS sells body serum candles: fragranced candles whose melted product can be applied to the skin in accordance with the relevant usage instructions.

We make every reasonable effort to display products, colours, packaging, sizes and fragrances as accurately as possible.

Screen settings, manual production, natural ingredients, batch variations and other production circumstances may result in minor differences.

Normal variations do not affect your statutory rights where the product does not conform to the agreement.

4. Product information and safe use

Use BODYKAARS only in accordance with the instructions provided on the product, packaging or our website.

In all cases:

place the candle on a stable, heat-resistant surface;
never leave a burning candle unattended;
keep a burning candle out of reach of children and pets;
extinguish the flame completely before pouring or applying the melted serum;
always test the temperature before contact with the skin;
use only a small amount initially;
for external use only;
avoid contact with the eyes and with damaged or irritated skin;
discontinue use if an adverse skin reaction occurs.

Any additional warnings and ingredient information displayed on the packaging or product page form part of the product information.

5. Offers and formation of the agreement

Products are offered subject to availability.

An order is placed when you complete the checkout process and submit the relevant payment instruction.

Once we receive your order, we will send an electronic order confirmation.

BODYKAARS may refuse or cancel an order where there is a valid reason to do so, including:

insufficient stock;
reasonable suspicion of fraud or misuse;
an obvious technical or pricing error where it should reasonably have been clear that the information was incorrect;
circumstances in which fulfilling the order would be unlawful.

Where BODYKAARS cancels an order that has already been paid for, the amount received for that order will be refunded.

6. Prices

All consumer prices displayed on the webshop are in euros and include applicable VAT unless expressly stated otherwise.

Any shipping charges will be clearly shown before the order is finally submitted.

BODYKAARS may change prices for future orders.

A price change will not affect an order for which an agreement has already been concluded at the previous price.

7. Payment

The available payment methods are displayed during checkout.

Payments are processed through the payment provider or providers available in the checkout at that time.

BODYKAARS is not required to dispatch an order until payment has been successfully processed, unless another payment arrangement has expressly been offered.

8. Discount codes and promotions

BODYKAARS may from time to time offer discount codes, promotions or other offers.

Unless otherwise stated:

discount codes cannot be exchanged for cash;
multiple discount codes cannot be combined;
codes are valid only during the stated promotional period;
individual promotions may be subject to additional terms.

Statutory consumer rights are not affected.

9. Delivery

BODYKAARS currently delivers exclusively within the Netherlands.

Please refer to our Shipping Policy for information regarding processing times, delivery times, shipping charges, tracking, damage and missing parcels.

10. Right of withdrawal and returns

Consumers generally have a statutory 14-day cooling-off period for online purchases.

11. Statutory guarantee and conformity

Products must meet the standard that you may reasonably expect under the agreement.

If a product is defective, damaged or otherwise does not conform to the agreement, please contact us at info@bodykaars.nl.

Nothing in these Terms & Conditions limits your statutory guarantee or conformity rights.

12. Complaints

If you have a complaint, please contact:

Where applicable, include your order number and a clear description of the complaint.

We aim to acknowledge receipt of complaints within 2 business days and to provide a substantive response within 14 days.

If more time is required, we will let you know.

BODYKAARS is currently not affiliated with an alternative dispute resolution body unless expressly stated otherwise on our website at a later date.

13. Liability

BODYKAARS is not liable for damage resulting from use of a product contrary to clear product, usage or safety instructions, to the extent that such liability may lawfully be excluded or limited.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

Your statutory consumer rights remain unaffected.

14. Force majeure

Where BODYKAARS is temporarily unable to perform its obligations due to circumstances beyond its reasonable control, performance may be delayed.

Such circumstances may include serious technical failures, transport disruption, government measures, natural disasters or other exceptional events.

Where reasonably possible, BODYKAARS will inform the customer of any material delay.

This clause does not limit any rights available to consumers under mandatory law, including the right to terminate an agreement where legally applicable.

15. Intellectual property

The BODYKAARS name, trade expressions, texts, photography, graphic elements, product presentation, design and other website content are owned by BODYKAARS or used with the permission of the relevant rights holder.

Without prior written permission, this content may not be copied, reproduced, published, distributed or commercially exploited except where permitted by law.

16. Misuse of the website

You may not use our webshop in a way that:

is unlawful or fraudulent;
damages the security or operation of the website;
infringes the rights of BODYKAARS or any third party;
distributes malware or harmful code;
is intended to circumvent technical security measures.

17. Privacy

Personal data is processed in accordance with our Privacy Policy and Cookie Policy.

18. Amendments

BODYKAARS may amend these Terms & Conditions for future orders, for example where our services or applicable laws change.

Orders already concluded will generally remain subject to the terms that applied at the time of purchase, unless a change is legally required or separately agreed with the customer.
